Terms & Conditions – Mobile Golf Co. (Australia)

These Terms & Conditions (“Terms”) apply to all bookings with Mobile Golf Co. By booking our mobile golf simulator, you agree to the following:

1. Services

Mobile Golf Co. provides mobile golf simulator hire for private events, parties, and functions. Specific inclusions, costs, and requirements will be outlined at the time of booking.

2. Bookings & Payment

  • A deposit of 50% is required to secure your booking.
  • Full payment is due 7 days prior to your event, unless otherwise agreed in writing.
  • Cancellations made more than 7 days before the event may be eligible for a refund (less any deposit or administrative fees). Cancellations made within 7 days are non-refundable.

3. Consumer Rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. For minor failures, we may choose to repair or resupply the service.

4. Event Requirements

  • The client must ensure adequate space, safe access, and a suitable power supply for the simulator setup.
  • The client is responsible for ensuring a safe environment for guests and equipment.

5. Liability

  • Guests use the simulator at their own risk.
  • Mobile Golf Co. accepts no responsibility for injuries, accidents, or damages caused by misuse, reckless behaviour, or unsafe conditions provided by the client.
  • The client is liable for any damage to equipment arising from negligence or misuse.

6. Conduct

We reserve the right to refuse or stop service if guests engage in unsafe, offensive, or inappropriate behaviour.

7. Insurance

Mobile Golf Co. maintains public liability insurance. Proof of cover can be provided on request.

8. Limitation of Liability

To the maximum extent permitted by law, Mobile Golf Co. is not liable for indirect or consequential loss arising from our services. Nothing in these Terms excludes or limits rights you may have under the ACL.

9. Changes to Terms

We may update these Terms from time to time. The latest version will be available on request.

10. Weather Conditions

Mobile Golf Co. operates an outdoor mobile service that may be affected by adverse weather conditions, including rainfall, strong winds, or other unsafe circumstances. If we determine that weather conditions prevent safe setup or operation of the simulator:

  • We will offer the client the option to reschedule the booking to a mutually agreed date at no additional charge.
  • If rescheduling is not possible, we may provide a credit note for future use.
  • Refunds will not be issued due to weather-related cancellations, except as required under the Australian Consumer Law.

11. Indoor Option in Adverse Weather

If adverse weather (including rainfall, wind, or extreme heat) prevents outdoor setup, the client may provide a suitable indoor venue for the simulator. The indoor venue must:

  • Have adequate space, access, ceiling height, and power supply as advised by Mobile Golf Co.
  • Be safe and accessible for delivery and setup of equipment.

If a suitable indoor venue is available, the booking will proceed as planned. If no indoor option is available, the Weather Conditions clause (Clause 10) will apply.
